For most complaints, AFCA's decisions are binding on the financial firm, but you do not have to accept it. If you do not accept the decision, you keep your legal rights to take your complaint to court.
Can you appeal an AFCA determination?
AFCA intends to resolve disputes through informal settlement processes and if not resolved, ultimately AFCA will make a final determination (Determination). Despite the finality of Determinations, AFCA does not provide financial firms an avenue of appeal.
Is financial ombudsman decision final?
If the ombudsman agrees with the investigator's opinion they will issue a final decision. An ombudsman's final decision is the final stage in our process, and it's legally binding if you accept it.
