In 1803, the U.S. Supreme Court decision Marbury v. Madison established the principle of judicial review.
Why was judicial review established?
Congress did not have power to modify the Constitution through regular legislation because Supremacy Clause places the Constitution before the laws. In so holding, Marshall established the principle of judicial review, i.e., the power to declare a law unconstitutional.
When did judicial review begin in India?
It is emphatically the provonce and duty of the judicial department to say what the law is". In India the power of judicial review was exercised by the courts prior to the commencement of the constitiution of india. the British Parliament introduced Federal System in India by enacting the Government of India Act 1935.
