When Can a Union Be Decertified?

Decertification occurs if a majority of the employees vote against the union. A tie vote will result in decertification because the union has received less than a majority of the votes cast. The NLRB does not accept decertification petitions for one year following a union's initial certification by the NLRB.

Can a union be decertified?

Decertification basically means getting rid of a Union. It happens when a majority of employees no longer support the Union or don't want the Union to represent them. If you can prove this you can decertify the Union.

Can a union be broken?

Workers may derecognize a union which either no longer has support from its members, or if union membership falls below 50%. Employers may derecognize a union if they no longer employ 21 or more workers.
