PHIPA applies primarily to personal health information in the hands of health information custodians. As part of this, it applies to agents of health information custodians (which includes employees).

Who is subject to PHIPA?

PHIPA applies to a wide variety of persons and organizations defined as health information custodians. PHIPA also applies to agents who are authorized to act for or on behalf of custodians.

Who or what is a contact person in PHIPA?

The information officer (called the “contact person” under PHIPA) need not be a practitioner (s. 15). The information officer is responsible for ensuring that the custodian puts in place and follows information practices (s. 10).
